Terms of sale
1. Scope
These terms apply to orders placed through the Daily Bear online store by consumers. Mandatory consumer law prevails over any conflicting clause.
2. Product information
We describe essential characteristics, ingredients, allergens, net quantity, instructions, warnings and price on the relevant product page before checkout. Packaging information prevails where a non-material online presentation difference exists. Contact us before use if information is unclear. Images are illustrative, but we aim to represent the product accurately.
3. Order and contract
Your order is an offer to purchase. An automatic receipt confirms that we received it; the contract is concluded when we expressly accept the order or dispatch the goods. We may refuse or cancel before acceptance for a genuine reason such as non-payment, unavailability, suspected fraud or an obvious price error, with prompt refund of any payment received.
4. Prices and payment
Prices shown to consumers include applicable VAT unless clearly stated otherwise. Shipping and any other mandatory cost are displayed before payment. Available payment methods appear in checkout. The goods remain our property until full payment, without limiting mandatory consumer protections.
5. Delivery
Delivery is governed by our shipping policy. Risk passes to the consumer when the consumer or their designated third party receives the goods, except where the consumer independently commissioned a carrier not offered by us.
6. Withdrawal and guarantees
The statutory right of withdrawal, its exceptions, our voluntary money-back guarantee and the legal conformity guarantee are explained in our returns and refunds policy.
7. Acceptable use
Do not misuse the website, circumvent security, upload malicious code, infringe rights or use the shop unlawfully. We may restrict access where reasonably necessary for security or legal compliance.
8. Liability
Nothing excludes liability that cannot legally be excluded, including mandatory consumer remedies. Subject to that rule, we are not liable for indirect loss that was not reasonably foreseeable when the contract was made. Website availability can be interrupted for maintenance or circumstances beyond reasonable control.
9. Force majeure
A party is not liable for delay caused by an event beyond reasonable control, but must take reasonable steps to limit its effect. If performance becomes impossible or excessively delayed, statutory termination and refund rights remain available.
10. Complaints
Email info@dailybear.be with your order number and a clear description. We aim to acknowledge a complaint within two business days. This service target does not affect legal deadlines or remedies.
11. Law and disputes
Belgian law applies, without depriving a consumer in another EU country of mandatory protection under their home law. Courts competent under applicable consumer law have jurisdiction. An unresolved consumer dispute may also be submitted to the Belgian Consumer Mediation Service where its conditions apply.
12. Changes and severability
The terms in force when the order is placed apply to that order. If one clause is invalid, the remainder stays effective to the extent legally possible.
